TERMS AND CONDITIONS OF SALE (TCS)
Artmaster.fr Platform
Article 1 – Purpose
These General Terms and Conditions of Sale (GTC) govern the conditions of use of the artmaster.fr platform, the terms of connection between artists and buyers, as well as the procedures for the sale of artworks offered through the platform operated by SAS 9 Vies.
Article 2 – Status and Role of the Platform
Artmaster.fr is an online platform within the meaning of Article L.111-7 of the French Consumer Code.
SAS 9 Vies acts exclusively as:
- an operator of a digital platform;
- a technical intermediary connecting artists and buyers;
- an intermediary in the payment process through an approved payment service provider.
SAS 9 Vies is not the owner of the artworks offered for sale and does not act as the seller.
The sales contract is concluded directly between the buyer and the seller (artist or art professional).
SAS 9 Vies provides artwork promotion, visibility among collectors, commercialisation through Artmaster.fr, and support in the commercial relationship between the parties.
Article 3 – Products
The artworks offered on Artmaster.fr are presented under the responsibility of the seller.
The seller guarantees:
- the authenticity of the artwork;
- its availability;
- the accuracy of the published information;
- compliance with applicable laws;
- respect for third-party rights.
Information relating to artworks, including descriptions, dimensions, techniques used, origin, and characteristics, is provided under the responsibility of the seller.
Each artwork sold must be accompanied by a certificate of authenticity issued by the artist.
Article 4 – Prices
Artwork prices are determined by sellers according to the terms provided in the cooperation agreement.
Prices are displayed in euros:
- including all taxes (TTC);
- or excluding taxes (HT) when the seller benefits from a VAT exemption regime.
The applicable tax regime is specified by the seller.
The SAS 9 Vies commission applies in accordance with Article 7 of these General Terms and Conditions of Sale.
Article 5 – Orders
Any order placed through the platform implies full and unconditional acceptance of these General Terms and Conditions of Sale.
The sale contract is concluded directly between the buyer and the seller upon confirmation of the order through the platform.
SAS 9 Vies acts solely as an intermediary within the transaction.
Article 6 – Payment
Payment is made through the platform at the time the order is placed.
Funds are collected:
- either by an approved payment service provider;
- or by SAS 9 Vies as part of the payment process on behalf of the seller.
Payment to the seller is made according to the conditions provided in the cooperation agreement, after confirmation of shipment of the artwork and in accordance with the applicable transaction deadlines.
The amount paid to the seller corresponds to the sale price minus the commission due to SAS 9 Vies.
Article 7 – Commission
In consideration of the promotion, visibility, commercialisation, and support services provided by SAS 9 Vies, a commission of thirty percent (30%) applies to each sale completed through Artmaster.fr.
The commission is calculated:
- on the amount excluding VAT (HT) when VAT applies;
- or on the total amount when the seller is exempt from VAT.
Article 8 – Delivery
The artwork is shipped directly by the seller to the buyer.
The seller is solely responsible for:
- packaging adapted to the nature of the artwork;
- protection of the artwork during transport;
- choice of carrier;
- shipping deadlines;
- any applicable insurance;
- proper completion of delivery.
SAS 9 Vies does not participate in logistics, storage, or transportation of artworks.
The seller provides SAS 9 Vies with the information required to monitor the order, including proof of shipment and tracking number.
Article 9 – Right of Withdrawal
In accordance with applicable law, the buyer has a period of fourteen (14) days to exercise the right of withdrawal, except where legal exceptions apply.
The artwork must be returned to the seller according to the procedures communicated to the buyer.
The artwork must be returned in its original condition and with all elements provided upon delivery.
SAS 9 Vies assists communication between the buyer and the seller during the return process.
Article 10 – Disputes and Mediation
Disputes relating to the sale of an artwork are handled directly between the seller and the buyer.
SAS 9 Vies may assist in facilitating communication between the parties, without replacing the seller and without any obligation to achieve a specific outcome.
Article 11 – Liability
SAS 9 Vies shall not be held liable for:
- the content of listings published by sellers;
- the accuracy of information relating to artworks;
- the conformity or authenticity of artworks;
- the performance of the sales contract concluded between seller and buyer;
- incidents related to transportation.
SAS 9 Vies does not participate in the creation, storage, or shipment of artworks.
Article 12 – Personal Data
Personal data is processed in accordance with the Privacy Policy available on artmaster.fr.
Article 13 – Applicable Law
These General Terms and Conditions of Sale are governed by French law.

GENERAL TERMS AND CONDITIONS OF USE (GTCU)
Article 1 – Purpose
These General Terms and Conditions of Use govern the use of the artmaster.fr platform.
Article 2 – Access
Access to the platform is reserved for persons who are legally adults and have the required legal capacity.
Article 3 – User Account
Users agree to provide accurate, complete, and regularly updated information.
Article 4 – Sellers’ Obligations
Sellers agree to:
- comply with applicable regulations;
- provide accurate information regarding the artworks offered;
- guarantee the authenticity of artworks;
- fulfil accepted orders;
- provide suitable and secure packaging;
- ship artworks to buyers;
- manage their tax and social obligations.
Article 5 – Non-Circumvention
Any transaction concluded with a buyer identified through the artmaster.fr platform shall be considered the result of the connection facilitated by SAS 9 Vies.
Consequently, any direct or indirect sale made outside the platform with a buyer introduced through artmaster.fr within twelve (12) months following the initial connection may result in payment of the commission due to SAS 9 Vies.
Article 6 – Sanctions
In case of breach of these Terms of Use, SAS 9 Vies reserves the right to:
- suspend or delete the user account;
- claim unpaid commissions;
- take any necessary legal action to recover damages suffered.
Article 7 – Intellectual Property
All elements composing the artmaster.fr platform are protected by intellectual property laws.
Article 8 – Liability
SAS 9 Vies acts as a platform operator and technical intermediary.
It is not a party to sales contracts concluded between sellers and buyers.
Article 9 – Applicable Law
These General Terms and Conditions of Use are governed by French law.
