TERMS AND CONDITIONS OF SALE (TCS)
Platform artmaster.fr
Article 1 – Purpose
These Terms and Conditions of Sale govern the terms of connection and sale of artworks offered via the platform artmaster.fr, operated by the company SAS 9 Vies.
Article 2 – Status and role of the platform
artmaster.fr is an online platform within the meaning of Article L.111-7 of the French Consumer Code.
SAS 9 Vies acts exclusively as:
– a digital platform operator,
– a technical intermediary for connecting users,
– and a payment collection service provider on behalf of third parties, through a licensed payment provider.
SAS 9 Vies is not the seller of the artworks offered.
The sales contract is concluded directly between the buyer and the seller (artist or art professional).
Article 3 – Products
The artworks offered are presented under the sole responsibility of the seller.
The seller guarantees:
– the authenticity of the artwork,
– its availability,
– its compliance with applicable laws,
– and respect for third-party rights.
Article 4 – Price
Prices are freely set by the sellers.
They are indicated in euros:
– including all taxes (TTC),
– or excluding taxes (HT) when the seller benefits from VAT exemption.
The applicable tax regime is specified by the seller.
Article 5 – Order
Any order placed via the platform implies full acceptance of these Terms and Conditions of Sale.
The sale is deemed concluded upon order confirmation.
Article 6 – Payment
Payment is made via the platform at the time of ordering.
Funds are collected:
– either by a licensed payment service provider,
– or by SAS 9 Vies on behalf of the seller.
Funds are transferred to the seller within a maximum of twenty (20) days after:
– shipping confirmation with tracking proof,
or
– confirmation of receipt by the buyer.
Article 7 – Commission
In consideration of its services, SAS 9 Vies charges a commission of thirty percent (30%).
The commission is calculated:
– on the net amount excluding tax (HT) where applicable,
– or on the total amount where the seller is VAT-exempt.
Article 8 – Delivery
The artwork is shipped directly by the seller to the buyer.
The seller is solely responsible for:
– packaging,
– transport,
– delivery times,
– insurance,
– and proper execution of delivery.
SAS 9 Vies is not involved in logistics.
Article 9 – Right of withdrawal
In accordance with applicable law, the buyer has a fourteen (14) day withdrawal period, except for legal exceptions.
The seller is solely responsible for handling returns.
Article 10 – Disputes and mediation
Disputes are handled directly between the seller and the buyer.
SAS 9 Vies may act as a mediator, without any obligation of result.
Article 11 – Liability
SAS 9 Vies shall not be held liable for:
– the content of listings,
– the conformity of artworks,
– the execution of the sales contract,
– or transport-related incidents.
Article 12 – Personal data
Data is processed in accordance with the Privacy Policy.
Article 13 – Governing law
These Terms and Conditions of Sale are governed by French law.

TERMS OF USE (TOU)
Article 1 – Purpose
These Terms of Use govern the use of the platform artmaster.fr.
Article 2 – Access
Access is reserved for legally capable adults.
Article 3 – User account
Users agree to provide accurate and up-to-date information.
Article 4 – Seller obligations
Sellers agree to:
– comply with applicable regulations,
– fulfil orders,
– ensure delivery,
– handle their tax and social obligations.
Article 5 – Anti-circumvention clause
Any transaction concluded with a buyer identified through the platform artmaster.fr is deemed to fall within the platform.
Accordingly, any sale made directly or indirectly outside the platform, within twelve (12) months following the introduction, shall result in the payment of the commission due to SAS 9 Vies.
Article 6 – Sanctions
In case of breach, SAS 9 Vies reserves the right to:
– suspend or delete the account,
– claim due commissions,
– take any legal action for compensation.
Article 7 – Intellectual property
All elements of the platform are protected by intellectual property law.
Article 8 – Liability
SAS 9 Vies acts as a technical intermediary and is not a party to sales contracts.
Article 9 – Governing law
French law.
